A few thoughts about the European Certificate of Succession

Since 17th August, 2015, the EU Regulation 650/2012 has been the governing document in EU succession matters.

This regulation has introduced the European Certificate of Succession, based on which, for example, following a probate procedure conducted by a Dutch, Belgian or German notary public, the heir’s (heirs’) ownership of Hungarian real estate inheritance, transferred to the heirs, will be registered in the Hungarian real estate register.

I would like to draw your attention to the fact that to achieve the desired legal effect (in the previous example, the registration of the heirs' ownership in the Hungarian real estate register), only the European Certificate of Succession issued pursuant to the EU Regulation 650/2012 is suitable, no other documents (e.g. the Dutch Verklaring van Erfrecht or a German Erbschein) are suitable for this purpose.
