On 1st July, 2024: the Land Act of Hungary is amended again

In many cases, the person entitled to the right of pre-emption exercised this right in an abusive manner, i.e. they did not actually have the purchase price. To remedy this issue, from 1st July, 2024, if the buyer has paid a deposit to the seller, the person entitled to the pre-emption is obliged to put down the amount of the deposit in advance (which can be a lawyer's deposit or, in the case of a contract recorded in a notarial deed, a notarial custody), and its proof must be attached to the legal declaration of the accepting party.

From 1st July, 2024, the amendment also stipulates that if there is an agreement on excess use in force for the ownership share to be purchased, this fact must also be stated in the sales contract; failure to do so will result in the nonapproval  of the contract by the authorities.
